How the agreement works.
The following clauses apply once a vehicle hire agreement has been signed by both parties. Clauses 1–6 set out the general conditions of hire; clauses 7–18 form the specific contractual obligations. All clauses are legally binding.
1 Agreement formation
The hire agreement is formed when both the lessor and hirer have signed the vehicle hire contract. No verbal agreement creates a binding hire obligation.
2 Condition of vehicle
The hirer takes possession of the vehicle in the condition noted on the hire agreement at the time of collection. It is the hirer's responsibility to inspect the vehicle and raise any concerns before driving away.
3 Lawful use
The hirer is responsible for ensuring the vehicle is used lawfully at all times. The hirer must comply with all road traffic legislation, TfL licensing conditions, and the requirements of their rideshare platform account.
4 Licence maintenance
The hirer must maintain a valid TfL PCO driver licence and an active, approved account with their rideshare platform for the full duration of the hire period. Loss of either must be reported to the lessor immediately.
5 Permitted drivers
The vehicle must not be sub-let, loaned, or driven by any person not named as an authorised driver in the hire agreement. Any breach of this condition voids the lessor's insurance cover for that use.
6 Insurance
The lessor maintains insurance on the vehicle for public liability and third-party cover in accordance with the Road Traffic Act 1988. The hirer is responsible for any excess charges, losses not covered by the policy, and any use outside the policy's permitted conditions.
Clauses 7–18.
The clauses below form Section 4 of every Vehicle Hire Agreement issued by FA-IBI LTD and are incorporated in full into these terms.
7 Indemnification
The hirer shall defend and indemnify the lessor from and against any and all losses, liabilities, damages, injuries, claims, demands, costs and expenses arising out of or connected with the possession or use of the vehicle during the rental term (except those covered by the lessor's insurance) and caused by negligence or non-observance of this agreement by the hirer, their driver, agents or employees.
8 Return on demand
Notwithstanding the period of hire shown overleaf:
- The lessor may demand return of the vehicle at any time if they become aware of activity by the hirer which could reasonably lead the lessor to believe the hirer is acting in a manner prejudicial to the preservation or upkeep of the vehicle.
- If the vehicle is not returned in accordance with (a), the hirer will pay hire charges at the lessor's published tariffs for any period of wrongful retention, including any administration charges incurred.
9 Payment terms
The hirer shall pay to the lessor hire charges and/or other charges that become due under this agreement by one single instalment within one month beginning with the date of this agreement.
10 Amendments
Any addition to or alteration of the terms and conditions of this agreement shall be null and void unless agreed upon in writing by the lessor and hirer.
11 Fire & theft
The hirer agrees to compensate the lessor in full for any loss in case of fire or theft.
12 Minimum hire period
Minimum hire period is 4 weeks.
13 Termination by hirer
The hirer may terminate the hire of the vehicle by giving 2 weeks notice and returning the vehicle to the lessor.
14 Bulbs & tyres
BULBS AND TYRES are the hirer's responsibility. TYRE MAINTENANCE NOT INCLUDED.
15 Road side recovery
ROAD SIDE RECOVERY IS NOT INCLUDED.
16 Daily checks
I (Hirer) fully agree to check OIL and WATER on a daily basis.
17 Data consent
I (Hirer) give my consent to share my details with third parties.
18 Penalty transfer
I (Hirer) give my consent to transfer all liabilities and penalty charges including Congestion Charge into my name.
These terms and conditions, and any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with the law of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
